The Orissa High Court has granted interim relief by directing extension of due date to 31-10-2015 as under:

Jagdish Prasad Mittal& another…Petitioner WP(C) No. 17178 & 17179 of 2015 Heard Mr. Panda, learned counsel for the petitioner and Mr. Acharya, learned counsel for the Income Tax Department. Learned counsel for the petitioner placed reliance on a judgment dated 29.09.2015 passed in CWP no. 19770 of 2015 by the High Court of Punjab & Haryana in the case of Vishal Garg and Others Vrs. Union of India and Another in which the said High Court was pleased to direct extension of due date for filing of returns up to 31 st October, 2015 with a further direction to the CBDT to issue fresh notification under section 119 of the Act. In view of the aforesaid conclusion arrived at by the Hon’ble Punjab and Haryana High Court, we issue notice in these writ applications directing extension of due date for e-filing of returns up to 31 st October, 2015 with a further direction to the CBDT to issue fresh notification under section 119 of the Act.
Counter affidavit, if any, be filed within two weeks . Free copy of this order be handed over to Mr. Acharya, learned Sr. Standing counsel for Income Tax Department. Urgent certified copy of this order be granted on proper application in course of the day. I. Mahanty, J. Dr. D. P. Choudhury, J.
