Mother's Name Print Option on PAN Card-New Form 49AA and 49AA

Note: Earlier in August, 2013, Delhi High Court has in an interim order allowed issue of PAN card to the petitioner without mentioning the name of the father. In the above case the bench directed that Counsel for respondents should obtain instructions whether in future a person applying for PAN card can be asked/required to furnish details of both father or mother with an option to indicate the parentage, he or she wants to be mentioned on the card.
Presently there are two forms for allotment of Permanent Account Number as under:
1. Form 49A for Indian Citizens, Indian Companies, Entities incorporated in India,Unincorporated Entities formed in India, and
2. Form 49AA for individuals not being citizens of India, Entities incorporated outside India, Unincorporated Entities formed outside India.
CBDT has vide its notification No.26/2014 dated 16 th May, 2014 has made amendments in Income Tax Rules and has substituted two new forms in place for existing forms.
In new PAN Form 49A and 49AA, line 6 is now titled as “Parents Name” as against earlier title of “Fathers Name”. Under parents details, after Fathers name fields, Mothers name option has been provided though fathers name continue to be compulsory.
Applicants are required to select the name of either father or mother which they would like to be printed on PAN Card. In case no option is selected PAN Card shall be issued with fathers name.
Please Note that these new forms shall be effective from the date it is published in Official Gazette till then current forms shall continue. It is also notable that despite fact that the Supreme Court in a recent judgement has recognised the third gender, New PAN Forms do not include option for a third gender.
