Rules for recruitment of Company Prosecutor in Ministry of Corporate Affairs

MCA has notified the Ministry of Corporate Affairs, Company Prosecutor, Group ‘B’, Gazetted Posts Recruitment Rules, 2024 regulating the method of recruitment to the posts of Company Prosecutor, in the offices of the Ministry of Corporate Affairs. These rules supersede the existing 2011 Rules.

The rules disqualifies those persons for appointment who have married with a person having spouse living; or who, having a spouse living, has married with any person. However, Central Government may, if such marriage is permissible under the personal law applicable to such person and the other party to the marriage exempt any person from the operation of this rule.

Number of Posts of Company Prosecutor shall be 120 in pay matrix of Level-7 (Rs.44,900 –1,42,400).

Age limit for direct recruits:
Not exceeding 30 Years. Relaxable for government servants upto five years in accordance with the instructions or orders issued by the Central Government.

Educational and other qualifications:
Bachelor degree in law or integrated degree in law from a recognized university or institution. Note.— Qualifications are relaxable at the discretion of the Union Public Service Commission for reasons to be recorded in writing, in the case of candidates otherwise well qualified.

Period of probation:
Two years Note: Direct recruits would be required to successfully Complete a mandatory induction training of at least two weeks duration, as prescribed by the competent authority, for completion of probation.

Method of recruitment:
By direct recruitment. Note: Vacancies caused by the incumbent being away on deputation or long illness or study leave or under other circumstances for duration of one year or more may be filled on deputation basis from officers of the Central Government.

Departmental Confirmation Committee:
The Departmental confirmation committee consists of:

1.Joint Secretary, Ministry of Corporate Affairs — Chairman;

2.Director or Deputy Secretary of administration, Ministry of Corporate Affairs — Member;

3.Under Secretary of administration, Ministry of Corporate Affairs — Member

Consultation with Union Public Service Commission is necessary while making direct recruitment.
