MCA Clarification on existing duplicate DINs:

The Ministry of Corporate Affairs vide press release as under clarified on the matter of duplicate DINs.

Director Indentification Number

As per MCA database, there are 7135 individuals holding multiple Director Identification Numbers (DINs) dating back to the period prior to June, 2011 when validation of application for DIN with the Income Tax PAN data was made compulsory.

While a few defaulters have already submitted applications for compounding of the defaults, directions have been issued for verification of all cases of the same individual holding more than one DIN. 
No fresh case relating to the period after June, 2011 has come to light. 

This was stated by Smt. Nirmala Sitharaman, MoS in the Ministry of Finance in written reply to a question in the Lok Sabha today

Prohibition on Duplicate DIN:

Section 155 of the Companies Act, 2013 prohibits obtaining or possessing duplicate Director Identification Numbers

Punishment for holding Duplicate DIN:
Section 159 of the Companies Act, 2013 prescribes the following punishment:
(a)    Imprisonment up to 6 months or
(b)    Fine up to Rs. 50000/-
(c)    For continuing defaults, Rs. 500/- per day

Cancellation or surrender of Duplicate DIN
The cancellation or surrender procedure has been prescribed in Rule 11 of  the Companies (Appointment and Qualification of Directors) Rules, 2014 is as under:
(a)   Holder of duplicate DIN shall make an application for surrender.
(b)   The application shall be in Form DIR-5 >>
(c)   The application shall be accompanied with a declaration that he has never been appointed as director in any company and the said DIN has never been used for filing of any document with any authority. Please note that giving false statement or evidence is punishable under section 448 and 449.
