CBI arrested an Assistant Commissioner of GST and a Chartered Accountant for alleged criminal conspiracy involving bribery
As reported in FIR lodged by the CBI, the Assistant Commissioner (AC), Goods and Service Tax (GST), Enforcement Wing, Delhi had conducted a survey cum seizure operation against a party. During the said survey cum seizure operation, GST team took possession of large number of incriminating documents regarding irregular financial dealings and irregularity of the party.
Pursuant to survey operation, the AC was required to submit a report to the Commissioner, GST. Thereafter, the said report had to go to concerned ward of GST department for further assessment proceedings and recovery of tax, if any not deposited.
As alleged, the Chartered Accountant of the party was pursuing the matter with the AC and was maintaining regular contact with AC and the party. Source informed that during such meetings, the CA told the party that AC had demanded bribe of Rs. 10 lacs for not digging demand of tax for a previous years and in the interest of maintaining good relations and good will for future.
It is reported that the demand was conveyed by the CA to the party who had agreed to pay Rs. 10 lacs to the AC.
Accordingly the CBI registered a case against the Assistant Commissioner, GST Enforcement Wing, New Delhi, Chartered Accountant and the director of the party with other unknown persons for alleged commissioning of cognizable offences punishable u/s 120B IPC r/w section 7, 7(A), 8, 9, 10 and 12 of Prevention of Corruption Act, 1988 (as amended in 2018) and Substantive offences thereof.
