MCA proposes more amendments to Companies Act 2013 – Read the list of amendments

MCA proposes more amendments to Companies Act 2013. Unspent amount of CSR to be transferred to a Special Account and spend within three financial years

Pursuant to the recommendations made by “Committee to review the offences under the Companies Act, 2013”, the Companies (Amendment) Ordinance, 2018 has been promulgated by the President of India on 2nd November, 2018.

Again, the Ministry of Corporate Affairs (MCA) has proposed fresh amendments to the Companies Act, 2013. According to the notice issued for inviting comments from the public/stakeholders, the Ministry, during examination of the recommendations of the said Committee, felt that certain other amendments of urgent nature would be required to strengthen the corporate governance & enforcement framework.

The MCA has made public the proposed amendments and Suggestion/Comments on the same alongwith justification in brief may be sent latest by 20th November, 2018 through email at comments_rbcao@mca.gov.in by clearly indicating the name, contact number, email address and postal address of the sender.

The format for sending suggestions/comments is as under:
